Terms of Service

The rules of the marketplace.

These terms cover buying, selling and everything the platform does in between. They are written to be read rather than to be survived — where a rule exists for a reason, the reason is given.

Two sections are worth reading before you do anything else. Section 5 explains the box you tick at checkout and why a purchase here is final. Section 10 explains what a confirmed fraud report costs a seller, which is a great deal more than the sale it was filed against.

    Who these terms are between

    Skillvel is a marketplace for finished student work, operated by [LEGAL NAME] — the full provider details are on the Imprint page. These terms govern your use of the site, whether you are buying, selling or only reading.

    Creating an account, listing a project or completing a purchase means you accept them. If you do not, do not do those things.

    What Skillvel is, and what it is not

    Skillvel is an intermediary. Sellers list their own work and set their own price; buyers pay the seller. Payments run as a direct charge on the seller’s own Stripe account, and Skillvel takes a commission from that charge — so the money is the seller’s, and the contract of sale is between the buyer and the seller. Skillvel is not the seller of the projects on it.

    What Skillvel does provide is the platform and the checks that come with it: the malware scan, the file-hash duplicate block, the Creator Certificate, the payment plumbing and the reporting route.

    Nothing on Skillvel is reviewed by a person before it is published, and no one at Skillvel checks whether a project is any good, whether it is correct, or whether it is fit for what you intend to do with it. Publication is automatic once the checks in section 8 pass.

    Your account

    One account covers both sides of the marketplace — there is no separate seller account. Buying needs an account; there is no guest checkout, because a download you keep permanently has to belong to somebody.

    • Give a real email address and keep it reachable. It is where receipts, download links and report notices go.
    • Keep your password to yourself. Anything done through your account is treated as done by you.
    • One account per person. Registering again to get around a suspension is itself a breach of these terms.
    • If you are under 18, you need your parent or guardian’s consent to use Skillvel, and to sell you need them to set up the Stripe account and receive the payouts. Your Skillvel account and any certificate you earn stay in your own name — they are separate systems.

    Buying a project

    Prices are shown in euros and are what you pay — there is no separate service charge added at checkout. Payment is handled entirely on Stripe’s hosted checkout page; Skillvel never sees your card details.

    [VAT TREATMENT]— whether prices include VAT, and who owes it, depends on the operator’s tax status and on whether the seller is acting commercially. This has to be settled before launch and stated here.

    Your purchase is confirmed when Stripe confirms the payment. The file then appears in your dashboard, where the download is unlimited and does not expire. A seller can pause a listing but can never delete it, which exists precisely so that what you bought cannot be taken away from you afterwards. A paused listing simply stops being offered to new buyers.

    Your right of withdrawal, and the waiver you give at checkout

    As a consumer you normally have 14 days to withdraw from a distance purchase without giving a reason. Digital content delivered immediately is the exception, and Skillvel relies on it, so it is worth being exact about what happens.

    Before you can pay, you have to tick one box confirming that you agree to these terms and that you waive your right of withdrawal. That tick is not a formality. Under § 356(5) BGB the right of withdrawal for digital content lapses once the trader has begun supplying it, provided the consumer expressly agreed to that and acknowledged that they were giving the right up. The checkbox is that express agreement and that acknowledgement, taken together.

    So: the moment the payment goes through, the file is available to download in full, and the withdrawal right is gone. A completed purchase on Skillvel is final. That is also why the checkbox cannot be skipped — the checkout route refuses a submission without it, not just the form.

    What the waiver does not touch:

    • Your statutory rights if what you received is defective or is not what the listing described. Those cannot be waived and are not affected by ticking anything.
    • The reporting and refund route in section 10, which stays open for 14 days after the purchase and is a separate mechanism from withdrawal.

    What you may do with a project you bought

    Every listing states a licence, either personal use or commercial use, and that is what you get. The seller keeps the copyright in their work; buying grants you the stated usage rights and nothing more.

    • Personal use covers your own private study, reference and reuse. It does not cover using the work in something you sell or ship commercially.
    • Commercial use additionally covers using the work in your own commercial projects.
    • Neither licence lets you resell, republish, redistribute or list the file again — here or anywhere else — or pass it on as your own work.

    Submitting purchased work as your own for academic credit is plagiarism at essentially every institution, and it is not something any licence sold here can permit. What you do with a file is your responsibility; the certificate names the seller as its creator precisely because it records who made it.

    Selling: what you are promising

    Before a listing is published you confirm that the project is your own work and that you hold the rights to it. Everything in this section follows from that one statement, and it is the statement a confirmed fraud report is measured against.

    • The work is yours. Not copied, not bought elsewhere and relisted, not generated and presented as your own project where the listing implies otherwise.
    • You are free to sell it. No third party’s copyright, no employer or client who owns the output, no university rule that assigns it elsewhere, and no personal data of other people inside the files.
    • The listing describes what is actually in the file — title, descriptions, screenshots, category and licence.
    • No malware, and no executables. Files ending .exe, .msi, .bat, .cmd, .ps1, .vbs, .dll, .com, .scr, .hta, .lnk, .reg, .wsf, .wsh, .jse, .vbe, .pif, .cpl, .msc are rejected outright, including inside a ZIP archive.
    • The main file is at most 95 MB, and the price is at least 2,00 €.

    The price is fixed when the listing is created and cannot be changed afterwards. Everything else about a listing can be edited. That is deliberate: your purchase confirmation and order history show the price you paid, tied to that listing, and a price that could move afterwards would make that record wrong the moment it changed.

    You can pause a listing at any time, which withdraws it from sale. You cannot delete one, because buyers keep permanent access to what they paid for.

    How a listing gets published

    There is no review queue and nobody approves a listing. Two automatic checks decide, and a listing goes live the moment both are satisfied — in whichever order they finish.

    • A malware scan. Every main file is hashed with SHA-256 and checked against VirusTotal. A file whose scan has not come back clean is never published. What that scan sends to a third party is described in the Privacy Policy and is worth reading before you upload.
    • A cover image. A listing without one stays private.

    The same SHA-256 hash also blocks duplicates: a main file that is byte-for-byte identical to one already listed is refused, so the same file cannot be listed twice by two people. It only catches exact copies — change one line and the hash differs — which is why the reporting route in section 10 exists as the backstop.

    A scan that cannot be completed leaves a listing unpublished rather than publishing it on the assumption that it is fine.

    Fees and payouts

    Listing is free. Skillvel takes a flat 12% commission on each completed sale and nothing else — no listing fee, no monthly fee, nothing deducted for the scan, the certificate or file hosting.

    Stripe’s transaction fee is separate and is charged to the seller’s own Stripe account, because the payment is a direct charge on that account rather than on Skillvel’s. Stripe’s fee depends on the card the buyer uses, so a seller’s share has no fixed percentage; in practice it lands between roughly 85% and 87% of the sale price. Skillvel does not estimate that figure on your order — the amounts recorded against a sale are read back from the settled Stripe transaction.

    The 2,00 €minimum price exists for this reason: part of Stripe’s fee is a fixed amount per transaction, so below that floor a sale could cost a seller more to process than it returns.

    Payouts are Stripe’s, not Skillvel’s. Stripe holds a new seller’s first payout for 7 days as fraud protection and pays out weekly after that, to the bank account given during Stripe’s verification. Skillvel neither schedules nor releases payouts and cannot shorten that hold. A full worked example of the split is on the How it works page.

    Reporting a project, refunds, and confirmed fraud

    Every listing page has a report button. Anyone can use it, including someone who never bought the project, and reporting has no deadline. A buyer who wants their money back has 14 days from the purchase to ask for a refund through it.

    Reports are read by a person. Nothing about the process is automatic up to that point, and a report on its own does nothing to a seller’s account — that is deliberate, so that an accusation cannot by itself remove someone.

    If a report is dismissed, nothing changes for the listing and both sides are told. If it is confirmed as fraud, the following all happen, and they are not separable — a seller listing a project is agreeing to this outcome in the case where a report against them is upheld:

    • The buyer’s payment is refunded in full.
    • The Creator Certificate for that project stops verifying.
    • The seller’s account is suspended.
    • Every listing they have is paused.
    • Every certificate they have ever earned stops verifying — not only the one attached to the report. A confirmed fraud puts the rest of the record in doubt, and the certificates are worth something only if that is true.
    • Their connected Stripe account is reported to Stripe for fraud.
    • A document package is generated recording the seller’s details, the transaction and the report, as the basis for a criminal complaint where one is warranted. Whoever reported the listing is not named in it.

    Invalidated certificates are not deleted. Their verification page keeps answering — it simply answers that the certificate no longer holds, because someone holding the ID is owed an answer either way.

    Suspension and ending your account

    Skillvel may suspend an account for a confirmed fraud report, for uploading malware, for evading an earlier suspension, or for a serious or repeated breach of these terms.

    You can stop using Skillvel at any time. Two things survive, and both are consequences of promises made to other people: buyers keep access to files they have paid for, so listings that have sold stay available to them, and completed orders and issued certificates remain on record so that a certificate someone is holding can still be verified. What this means for your personal data, and what can be erased, is in the Privacy Policy.

    Liability

    Skillvel is liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever liability is mandatory by law. For slight negligence, Skillvel is liable only where an obligation essential to the purpose of this agreement is breached, and then only for the damage typically foreseeable in a contract of this kind.

    Beyond that: Skillvel does not warrant that any project on the site is correct, complete, original or fit for a particular purpose. The malware scan reduces risk, it does not eliminate it — no scanner catches everything. Claims about a project itself lie against the seller, which is the counterparty in the sale.

    [REVIEW REQUIRED] — German law is restrictive about limiting liability in standard terms, and an over-broad clause here is void rather than merely unenforceable, which can be worse. This section in particular needs a lawyer.

  13. 13

    Changes to these terms

    These terms may change as Skillvel changes. The revision date at the top of the page says when they last did. Where a change materially affects you, registered users will be told by email before it takes effect. Terms already applied to a completed purchase are not changed retroactively.

  14. 14

    Governing law

    German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

    If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may bring proceedings there.

    If any provision of these terms is or becomes invalid, the rest stays in force.
